Builders Outlet — Terms & Conditions

These Terms & Conditions (“Terms”) govern your access to and use of the Builders Outlet website(s) and online store (collectively, the “Site”). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.

1) Who we are

2) Eligibility & account

3) Product information, pricing & availability

  • We strive for accuracy but do not warrant that product descriptions, images, specifications, pricing, or availability are error-free.

  • We may correct errors, update information, or change pricing and availability at any time without notice.

  • All prices are in USD unless stated otherwise and may exclude shipping and taxes, which are calculated at checkout.

4) Orders & acceptance

  • Your order is an offer to buy; we may accept or reject any order in our sole discretion (for example, due to product availability, suspected fraud, or pricing errors).

  • If we cancel an order after charging you, we will issue a prompt refund to your original payment method.

5) Payments

  • We accept the payment methods shown at checkout. By submitting an order, you represent that you are authorized to use the selected payment method and authorize us (and our payment processor) to charge the full amount, including taxes, shipping, and applicable fees.

6) Sales tax & other taxes

  • We collect applicable taxes based on the shipping address and current laws. You are responsible for any additional taxes, duties, or fees required by your jurisdiction.

7) Shipping, delivery & risk of loss

  • Large or heavy items may ship via freight and are typically curbside delivery only. You are responsible for moving items from curbside and for any required equipment or labor. Please note and photograph any damage on the delivery receipt before signing.

9) Returns & refunds

  • Process: Contact us for an RMA and return instructions. Unauthorized returns may be refused. Return shipping costs (and a [15%] restocking fee if applicable) may be deducted from your refund unless the return is due to our error.

  • Refunds are issued to the original payment method after we receive and inspect the item.

10) Promotions, coupons & gift cards

  • Promotions and coupon codes are subject to terms stated with the offer, may not be combined, and are not redeemable for cash.

  • Gift cards are non-refundable and not reloadable, except where required by law. Safeguard gift card codes like cash.

11) User content (reviews, photos, Q&A)

  • If you submit reviews, photos, or other content (“User Content”), you grant Builders Outlet a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, publish, translate, create derivative works from, and display such Content in connection with the Site and our business.

  • You represent that you own or control all rights in your User Content and that it does not infringe any third-party rights or violate any law.

12) Acceptable use

You agree not to:

  • Use the Site for unlawful, fraudulent, or harmful purposes;

  • Interfere with the Site’s operation or security;

  • Scrape, harvest, or collect information by automated means without permission;

  • Upload malware, spam, or content that is defamatory, obscene, or infringing.

13) Intellectual property

The Site, including text, graphics, logos, product photos, videos, and software, is owned by Builders Outlet or its licensors and protected by intellectual property laws. Except as expressly allowed, you may not copy, reproduce, distribute, or create derivative works from the Site’s content. You are granted a limited, revocable license to access and make personal, non-commercial use of the Site.

14) Third-party services

The Site may reference or interoperate with third-party tools or services. Builders Outlet is not responsible for third-party sites, services, or their terms or policies.

15) Warranties & disclaimers

  • Except as expressly stated, the Site and all products and services are provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, title, and non-infringement.

  • Some jurisdictions do not allow limitations on implied warranties; some or all of the above may not apply to you.

16) Limitation of liability

To the maximum extent permitted by law, Builders Outlet and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or use, arising out of or related to your use of the Site or the purchase/use of products, even if advised of the possibility of such damages. Our total liability for any claim will not exceed the amount you paid for the product giving rise to the claim.

17) Indemnification

You agree to defend, indemnify, and hold harmless Builders Outlet and its officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your breach of these Terms, your misuse of the Site, or your violation of law or third-party rights.

18) Health, safety & installation

Some products may require professional installation or involve safety risks if misused. Always follow manufacturer instructions, building codes, and safety guidelines. Builders Outlet is not responsible for injuries or damage resulting from improper selection, installation, or use.

19) Export & compliance

You agree to comply with all applicable import/export, customs, and sanctions laws and regulations. You may not use the Site or purchase products for any prohibited end-use.

20) Termination

We may suspend or terminate your access to the Site at any time, with or without notice, for any reason, including if we believe you have violated these Terms.

21) Changes to the Site and to these Terms

We may modify or discontinue the Site (in whole or in part) at any time. We may update these Terms from time to time; the “Effective date” indicates when changes took effect. Your continued use of the Site after changes are posted constitutes acceptance.

22) Governing law & venue

These Terms and any disputes arising out of or related to them are governed by the laws of the State of Colorado, without regard to conflict-of-laws principles. You agree to the exclusive jurisdiction and venue of the state and federal courts located in Denver, Colorado.

23) Severability; waiver; assignment

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force. Our failure to enforce any right does not waive it. You may not assign your rights or obligations without our prior written consent; we may assign these Terms as part of a merger, acquisition, or sale of assets.

24) Force majeure

We are not liable for delays or failures to perform due to events beyond our reasonable control, including acts of God, labor disputes, supply shortages, transportation issues, or government actions.

25) Entire agreement

These Terms, together with any policies or terms referenced herein (including our Privacy Policy and any sale-specific terms shown at checkout), constitute the entire agreement between you and Builders Outlet regarding the Site and your orders.
